Welcome to TRIPPER (“we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, and services (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By registering for and/or using the Service in any manner, you agree to all of the terms and conditions contained herein, including our Privacy Policy and other applicable terms referenced herein.
2. Service Accessibility
2.1. The Service is accessible via our website at trippernow.com and through our iOS and Android mobile applications under the name “TRIPPER”.
2.2. Access to one platform allows seamless usage across all platforms.
2.3. To access certain features, you must register an account by purchasing access, redeeming a golden ticket code, receiving an invitation, or gaining access from our waiting list.
2.4. We may limit access to the Service based on availability, technical, or commercial constraints.
3. Description of Service
3.1. TRIPPER is a Software as a Service (SaaS) platform enabling users to search for and book multiple flight tickets simultaneously.
3.2. TRIPPER is not an airline or travel agent. We act solely as a reseller of flight tickets obtained from third parties, including airlines and consolidators.
3.3. We are not responsible for the operation, reliability, or scheduling of any flights, nor for the ultimate delivery of services by any airline or travel provider.
3.4. TRIPPER is not responsible for the accuracy, legality, or completeness of data provided by third parties such as airlines, consolidators, or global distribution systems (GDS). If any information is incorrect or originates from unauthorized or unlawful sources, TRIPPER bears no liability for any consequences arising from such errors.
4. Prices and Payments
4.1. Prices displayed are subject to change without notice. Prices may fluctuate during your search or purchase process.
4.2. If we cannot secure your ticket at the displayed price, you will be informed and may:
- a. Pay the difference (information will be provided in the app or by email), or
- b. Cancel the affected transaction(s).
4.4. Except as explicitly provided, all payments are non-refundable.
5. Ticket Purchases
5.1. All ticket purchases are non-refundable and non-transferable once completed.
5.2. You cannot modify passenger or flight details post-purchase.
5.3. We are not liable for errors in bookings, airline schedule changes, or reservation issues.
5.4. By purchasing, you acknowledge that no right of withdrawal applies under UK Consumer Contracts Regulations 2013 or EU Directive 2011/83/EU, as transport services are exempt when tied to specific dates.
6. Limitation of Liability
6.1. To the maximum extent permitted by applicable law, TRIPPER shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, goodwill, data, or business interruption.
6.2. We disclaim responsibility for issues caused by airlines, aggregators, or external service providers.
6.3. Users accessing the Service from jurisdictions outside of the UK and EU acknowledge and agree that any legal disputes or claims shall be governed by Section 11. You explicitly waive any rights or protections under foreign laws, including but not limited to consumer protection, jurisdictional, or public policy rules that may otherwise apply.
6.4. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.
6.5. TRIPPER disclaims any liability arising from compliance with international conventions, including but not limited to the Montreal Convention, Warsaw Convention, and relevant treaties or transportation regulations.
6.6. All users outside of the United Kingdom and the European Union, including but not limited to individuals and entities from the United States, Canada, Asia-Pacific, Latin America, Africa, or other international jurisdictions, expressly acknowledge and agree that they are using the Service entirely at their own risk and that TRIPPER disclaims any and all warranties, liabilities, or legal obligations under any non-UK or non-EU laws or regulations.
6.7. TRIPPER accepts no responsibility for any errors, omissions, or misinformation provided by external data sources such as airlines, consolidators, or global distribution systems (GDS), whether or not such data is accurate, complete, legal, or obtained from authorized sources.
7. User Responsibilities
7.1. You agree to provide accurate and up-to-date information.
7.2. You shall not use the Service for illegal or prohibited purposes.
7.3. You are solely responsible for verifying that the data provided (e.g., names, passport numbers) is accurate at the time of booking.
8. Intellectual Property
All content, trademarks, code, and data on our platforms (including graphics, icons, and software) are owned by or licensed to TRIPPER and protected under intellectual property laws.
9. Termination
We reserve the right to suspend or terminate access without prior notice or liability for any reason, including violation of these Terms.
10. Modifications to Terms
We may revise these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Service after updates constitutes your acceptance.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of courts in the United Kingdom.
If you are an EU consumer, local mandatory consumer protection laws apply. Disputes may also be referred to the European Commission's Online Dispute Resolution platform.
For users located outside the UK and EU, you agree that the laws of England and Wales exclusively govern these Terms, and you submit to the exclusive jurisdiction of the UK courts, waiving any right to claim jurisdiction under your local laws.
12. International Arbitration (Non-UK/EU Users)
12.1. For users not located within the UK or European Union, any dispute, controversy or claim arising out of or relating to these Terms, or the breach, termination or invalidity thereof, shall be finally settled by arbitration under the rules of the London Court of International Arbitration (LCIA).
12.2. The number of arbitrators shall be one. The seat of arbitration shall be London, United Kingdom. The language shall be English.
12.3. The arbitral award shall be final and binding, and judgment may be entered in any court having jurisdiction.
13. Severability
If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms represent the entire agreement between you and TRIPPER regarding the use of the Service and supersede all prior agreements.
15. No Warranties
15.1. The Service is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation.
15.2. We disclaim all express and implied warranties, including merchantability and fitness for a particular purpose.
15.3. Your use is at your own risk.
15.4. We make no warranties or representations regarding the legality of your use of the Service in jurisdictions outside of the United Kingdom. Users are solely responsible for ensuring compliance with applicable laws in their own countries.
